Terms of Use

1. Acceptance and Scope

These Terms form an agreement between you and the Penzy developer regarding your download, installation, access to, and use of the Penzy iOS App, testing versions, static website pages, and related local features. By confirming notices, starting a record, continuing to use the App, or using related features, you acknowledge that you have read, understood, and agreed to these Terms and the Privacy Policy.

If you do not agree to these Terms or the Privacy Policy, stop using Penzy and delete the App. The service provider is the Penzy developer. Contact: hazen_sun@foxmail.com. If the App Store listing shows a different legal seller or developer entity, the App Store listing controls for that store context.

If you use Penzy through TestFlight or another testing channel, the testing version may be unstable and its features, data structure, prices, download access, and displayed copy may change. A testing version is not a promise of public release.

2. Service Scope

Penzy is designed for personal records under external professional guidance. The current version provides local features including:

• Recording body weight, body fat, waist circumference, appetite, discomfort, notes, and medication execution.
• Recording drug names, specifications, inventory source, batch number, expiry date, remaining doses, low-stock threshold, and active inventory.
• Setting weight reminders and medication-day reminders based on the external plan that you enter.
• Reading the last 30 days of body weight, body fat percentage, and waist circumference from Apple Health only after your authorization, for onboarding prefill and local trend records.
• Displaying local calendars, trends, and reports, and supporting local CSV export.
• Sending feedback or recommendation text through system mail or share-sheet features when you choose to do so.

Penzy does not require account registration, and does not provide community features, doctor consultation, drug purchasing, prescription review, drug authenticity verification, insurance advice, advertising delivery, health-data trading, or automated medical decisions.

Drug names, specifications, sources, batch numbers, medication dates, reminder cycles, and charts shown in Penzy come from what you enter, what you choose from presets, or what you authorize from Apple Health. They are for organizing records only and do not mean that we verify their truth, legality, safety, or suitability for you.

3. Medical Safety Boundary

• No medical advice: Buttons, forms, preset drug names, inventory fields, charts, reminders, and exports are record-display tools only. They are not diagnosis, treatment, prescriptions, drug purchasing, dosage adjustment, or efficacy evaluation.
• No plan verification: Penzy does not verify whether a drug, dose, cycle, source, batch, expiry date, or inventory entry is real, legal, suitable for you, or consistent with drug instructions.
• No replacement for professionals: Weight, BMI, trends, and discomfort records may be incomplete, inaccurate, delayed, or affected by devices, input, timing, and personal conditions. They should not be used as standalone medical evidence.
• No emergency handling: Penzy does not provide emergency response, alarm services, remote monitoring, or real-time risk alerts. For severe discomfort, suspected allergic reaction, dehydration, persistent vomiting, severe abdominal pain, suspected hypoglycemia, or other urgent symptoms, seek medical help immediately.
• Medication risks must be externally confirmed: GLP-1 and related medicines may involve indications, contraindications, interactions, and adverse reactions. Follow doctors, pharmacists, and official drug instructions.
• No outcome promise: Penzy does not promise weight-loss results, treatment results, improved adherence, or any health outcome. Charts only reflect records you enter or import.

4. Your Responsibilities

You agree that you will:

• Use Penzy only for lawful, compliant, truthful, personal recording, and not for illegal drug purchasing, drug resale, evading medical regulation, falsifying records, or misleading others.
• Be responsible for records you enter. Inaccurate, incomplete, outdated, deleted, or exposed records may affect your health decisions, privacy, and interests.
• Not record or submit another person's health, medication, identity, payment, medical-record, or contact information unless you have lawful authorization and accept responsibility.
• Not submit identity documents, complete medical records, prescription photos, insurance information, payment proofs, third-party personal information, or unnecessary sensitive materials in feedback.
• Protect your device, system account, backups, and exported files. You manage the risk after you export, save, forward, or share data.
• Not reverse engineer, crack, bypass paid limits, forge purchase proofs, disrupt App operation, or use automation or abusive methods against the service.
• Not use Penzy records or exports for fraudulent reimbursement, insurance fraud, fabricated evidence, misleading medical professionals, or any unlawful or improper purpose.

5. Free Version and Paid Unlocks

The current product boundary is: the free version supports local records within a limited period, and a permanent unlock enables longer local record keeping and full custom options such as custom medicines, sources, specifications, body parts, and discomfort items. Actual prices, purchase regions, and available features are shown in the App and App Store.

If the public version offers purchases through App Store, payment, taxes, invoices, refunds, family sharing, restore purchases, subscriptions, or non-consumable items are handled by Apple under its rules. Penzy does not directly collect bank card numbers, payment accounts, or payment passwords. Unless required by law or Apple's rules, an unlocked digital feature does not mean we provide medical, drug, or offline services.

A permanent unlock refers to access to the corresponding current-version features. It does not guarantee that all future new features will be included for free, or that service scope will never change due to system, device, store-policy, legal, or product-form changes.

6. Testing Versions and Availability

Penzy may provide access through Alpha, Beta, TestFlight, or limited testing channels. Testing versions may crash, change data structures, fail to export, miss notifications, fail to read Apple Health, have unavailable StoreKit products, change interfaces, or remove features. Do not treat a testing version as your only record source or emergency reminder tool.

If you rely heavily on certain records, export CSV regularly, keep prescriptions and official drug instructions separately, maintain independent backups, and use professional channels for important medical matters.

7. Data and Privacy

Penzy processes local records, sensitive personal information, notifications, read-only Apple Health imports, exports, and feedback according to the Privacy Policy. The current version does not upload health records by default, does not include advertising SDKs, and does not include analytics SDKs. Apple Health data is read only after authorization, limited to the last 30 days of body weight, body fat percentage, and waist circumference, stored locally, not uploaded by default, not used for advertising, and not written back to Apple Health.

You retain rights to content that you enter. You choose recipients and assume the related risk when you actively send content through system sharing, CSV export, email feedback, or other methods. You should understand that iCloud backup, device migration, system notifications, Apple Health, App Store, TestFlight, email services, and third-party share destinations may have their own rules.

8. Intellectual Property

The Penzy App interface, copy, icons, code, structure, design, trademarks, name, and related materials are owned by the Penzy developer or relevant rights holders, except for third-party materials or content you enter. Without permission, you may not copy, adapt, distribute, sell, rent, reverse engineer, or use them for a competing product.

9. Service Changes, Interruptions, and Termination

We may adjust Penzy features, pages, prices, name, scope, and service methods because of product iteration, system compatibility, App Store policy, law, security risk, or operational arrangements. For material changes, we will provide notice through the App, App Store information, website updates, or other reasonable means.

If you violate these Terms, law, or platform rules, or if your conduct creates service disruption, security risk, infringement, fraud, or illegal use, we may restrict, suspend, or terminate relevant service to the extent permitted by law.

Local record features depend on iOS, device storage, system permissions, App Store, HealthKit, local notifications, and the file system. Changes in those environments, device damage, system upgrades, failed restore, insufficient storage, or third-party service issues may affect availability.

10. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the Penzy developer is not responsible beyond mandatory legal liability for:

• Medical, medication, purchasing, weight-management, or lifestyle decisions made by you or others based on App records, reminders, charts, or exports.
• Losses caused by incorrect input, omission, delayed records, accidental deletion, device loss, system failure, backup failure, missed notifications, or third-party app processing.
• Information exposure or disputes caused by your sharing, exporting, feedback sending, or allowing others to access your device.
• Services, content, or data issues caused by doctors, pharmacists, drug instructions, medical institutions, drug suppliers, email providers, Apple, carriers, or other third parties.
• Unavailable features caused by testing versions, system permission changes, App Store review policy, Apple Health authorization status, StoreKit product status, or regional restrictions.

These Terms do not exclude or limit liability that cannot be excluded or limited by law. If applicable law gives you consumer rights, personal-information rights, or other mandatory rights that cannot be waived by agreement, these Terms do not affect those rights.

11. Minors

Penzy is not directed to children under 14. Minors should use it only with guardian consent and supervision, and guardians are responsible for assessing medication, records, exports, and privacy risks. Medication-related matters should always follow doctors, pharmacists, and official drug instructions.

12. Third-Party Terms

When you use App Store, TestFlight, Apple Health, iCloud backup, system notifications, email services, or share-sheet destinations, Apple's or another third party's terms, privacy policies, payment rules, refund rules, and developer-program requirements may also apply. The third party is responsible for its own service availability, data processing, and dispute handling under its rules.

13. Changes and Severability

We may update these Terms because of product iteration, law, platform policy, or compliance requirements. Updates may be shown through the website, the App, App Store information, or other reasonable means. Continued use after an update means you accept the updated Terms.

If any provision is found invalid, unlawful, or unenforceable, the remaining provisions remain effective. Headings are for readability only and do not affect interpretation.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of mainland China, excluding conflict-of-law rules, unless mandatory consumer-protection or personal-information-protection laws in your location cannot be excluded by agreement.

Disputes arising from these Terms or your use of Penzy should first be resolved through friendly negotiation. If negotiation fails, disputes may be submitted to a court with proper jurisdiction.
